NetBackup ignoring DFSR exclusions

I have several servers where SCC is getting backed up in full even though I have excluded DFSR from it.  Opened case # 04639391.

This is the explanation I got from support:

"The exclude is not working because the backup of Shadow Copy is failing. I currently have another case with  Windows 2003 running DFSR failing with the same error in Backline now. When I get a fix for that issue I will be able to address your issue so the exclude will work."

Sounds like an EEB is in the works.  If you are having this issue, open a case and reference my case listed above.
